This Privacy Policy explains how WE ART CO., LTD, trading as ART.ANETKA (“we”, “us”, “our”), collects, uses, and protects your personal data when you visit https://artanetka.art/ (the “Site”) or book our photography services.

We are based in Koh Samui, Thailand. For any privacy question, contact us at hi@artanetka.art.

1. Which laws apply

We process personal data in accordance with Thailand’s Personal Data Protection Act (PDPA). If you access the Site or book from the European Economic Area (EEA) or the United Kingdom, we also aim to comply with the EU/UK General Data Protection Regulation (GDPR).

2. What we collect

  • Information you give us directly — when you submit our contact form, message us on WhatsApp or Telegram, or book a shoot: your name, email address, phone or messenger contact, and any details you share about your session (dates, location, group size, preferences).
  • Booking and payment information — the details needed to arrange and invoice your shoot. We do not store full card or bank details; payments are handled by third-party providers (see Section 6).
  • Information collected automatically — when you browse the Site, limited technical data such as your IP address, browser type, device, pages viewed, and referring source, collected through cookies and analytics (see Section 3).

3. Cookies and analytics

The Site uses cookies and similar technologies:

  • Essential cookies — required for the Site to function.
  • Analytics cookies — we use Google Analytics 4 to understand how visitors use the Site so we can improve it. These cookies are only set with your consent where required.

Our chat and booking buttons (WhatsApp, Telegram) may load third-party scripts that set their own cookies, governed by those providers’ privacy policies.

You can control or delete cookies through your browser settings. Blocking some cookies may affect how the Site works.

4. How we use your data

We use your personal data to:

  • respond to your enquiries and messages;
  • arrange, deliver, and manage your photography session;
  • process payments and issue invoices;
  • meet our legal, accounting, and tax obligations under Thai law;
  • feature images in our portfolio and marketing, as governed by our separate Image Release & Usage Terms;
  • send you service-related communications and, with your consent, occasional marketing.

5. Legal grounds (GDPR)

Where GDPR applies, we rely on: performance of a contract (to deliver a booked shoot), consent (analytics cookies, marketing), legitimate interests (running and improving our business, portfolio use), and legal obligation (tax and accounting records).

6. Payments and third parties

We accept payment via PayPal, Payoneer, cash, and cryptocurrency. When you pay by PayPal or Payoneer, your payment details are processed directly by those providers under their own privacy policies. Cryptocurrency transactions are recorded on a public blockchain, which is outside our control. Cash payments involve no online data.

We also share data with service providers who help us operate, including our website host and Google (analytics). We never sell your personal data.

7. International transfers

Some of our providers (for example Google, PayPal, and Payoneer) are located outside Thailand, including in the United States. Where we transfer your data internationally, we take reasonable steps to ensure it remains protected in line with PDPA and GDPR requirements.

8. How long we keep it

  • Enquiries that do not lead to a booking — deleted within around 12 months.
  • Booking, invoice, and financial records — kept for the period required by Thai tax and accounting law (generally 5 years).
  • Photographs — retained and used as set out in our Image Release & Usage Terms.

9. Children

Family sessions may include children. We only photograph and process a minor’s personal data or images with the consent of a parent or legal guardian, who books on the child’s behalf.

10. Your rights

Subject to PDPA and, where applicable, GDPR, you may: access the data we hold about you; correct inaccurate data; request deletion; object to or restrict certain processing; withdraw consent at any time; and request a copy of your data in a portable format.

To exercise any right, email hi@artanetka.art. You also have the right to lodge a complaint with Thailand’s Personal Data Protection Committee (PDPC) or, if you are in the EEA/UK, your local data protection authority.

11. Security

We take reasonable technical and organisational measures to protect your personal data against loss, misuse, and unauthorised access. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

12. Changes

We may update this Policy from time to time. The “Last updated” date at the top reflects the latest version.
