These Booking Terms apply to all photography services provided by WE ART CO., LTD, trading as ART.ANETKA (“Photographer”, “we”, “us”), to you (the “Client”). By paying a deposit, you agree to these Terms.
1. Booking and confirmation
A session is only confirmed once the Client has paid the required deposit and received confirmation of the date, time, and location. Until then, dates are held provisionally and may be offered to other clients.
2. Deposit
A non-refundable deposit of 30% of the total session price is required to confirm a booking. The deposit secures your date and covers our planning and preparation.
The deposit may be refunded, at our discretion, where the session cannot go ahead due to genuine unforeseeable circumstances (for example serious illness or severe weather that makes the shoot impossible). In such cases we will first offer to reschedule (see Section 4).
3. Balance payment
The remaining balance is due on the day of the shoot (you can change this to “before final delivery” or another point — set your preferred rule here).
We accept payment by PayPal, Payoneer, cash, and cryptocurrency. Any transaction or processing fees are the Client’s responsibility unless agreed otherwise.
4. Rescheduling
Rescheduling is possible. Because outdoor shoots in Koh Samui can be affected by rain, especially in the wet season, we may propose a new date if weather makes the planned session unworkable, at no penalty. The Client may also request to reschedule; we will do our best to accommodate a new date subject to availability. We ask for as much notice as possible.
5. Cancellation
- By the Client: the 30% deposit is non-refundable, except in the unforeseeable circumstances described in Section 2.
- By the Photographer: if we must cancel and cannot offer a suitable alternative date, the Client receives a full refund, including the deposit.
6. Deliverables
Deliverables depend on the package booked. As a standard reference:
- 10 fully edited (retouched) final images;
- up to 50 color-corrected images;
- delivery within 7–14 days of the shoot, typically via an online gallery or download link.
Additional edited images are available at 300 THB per image.
Editing is performed in the Photographer’s artistic style. We do not provide raw/unedited files.
7. Client responsibilities
The Client agrees to: arrive on time; cover any location entry fees, permits, or venue charges where applicable; and behave respectfully toward the Photographer and any assistants. Lateness may reduce the effective shooting time without extending the session.
8. Minors
Where a session involves children, a parent or legal guardian must book on their behalf and be present or have authorised an accompanying adult. Consent for any publication of a minor’s images is covered by our Image Release & Usage Terms.
9. Weather and force majeure
We are not liable for delays or cancellations caused by events beyond our reasonable control, including weather, illness, accidents, travel disruption, or government restrictions. In such cases we will offer to reschedule.
10. Image rights
Copyright in all images remains with WE ART CO., LTD. The Client’s use of images, and our use of images for portfolio and marketing, are governed by our separate Image Release & Usage Terms, which form part of this Agreement.
11. Limitation of liability
To the fullest extent permitted by Thai law, our total liability in connection with a session is limited to the amount paid by the Client for that session. We are not liable for indirect or consequential loss.
12. Governing law
This Agreement is governed by the laws of Thailand.
