These Terms explain who owns the photographs from your session, how you (the “Client”) may use them, and how WE ART CO., LTD, trading as ART.ANETKA (the “Photographer”), may use them. They form part of our Photography Services Agreement.
1. Copyright
All photographs created during your session are original creative works. Copyright in every image remains with WE ART CO., LTD at all times. Delivery of images to the Client does not transfer copyright.
2. Client’s license
Once your session is paid in full, you receive a personal, non-exclusive, non-commercial license to use your delivered images. You may:
- keep, print, and display them for personal use;
- share them on your personal social media, with a credit to ART.ANETKA where possible.
You may not:
- sell, license, or use the images for commercial or advertising purposes;
- claim authorship of the images;
- substantially edit, filter, or alter the images in a way that changes the Photographer’s creative style, or crop out any watermark or credit.
Commercial, brand, or editorial usage requires a separate written license and may involve an additional fee.
3. Photographer’s use of images
Unless the privacy option in Section 4 applies, the Photographer may use images from your session in its portfolio, website, social media, and marketing materials. This helps promote the business and is reflected in our standard pricing.
4. Privacy option (opt-out)
If you prefer that the Photographer does not publish or share your images publicly (for example on our website or social media), you may opt out. Choosing this privacy option adds a fee of 1,000 THB to your session.
(Note to the business: this reflects “if the client does not allow their content to be published, +1,000 THB.” If you intended a different arrangement, adjust this section.)
5. Minors
Images of children will only be published by the Photographer with the explicit consent of a parent or legal guardian. A parent or guardian may withdraw that consent for future publication at any time by contacting us.
6. Third parties in images
If your session includes other people (for example a partner, family members, or guests), you confirm that they are aware of and agree to these Terms, including any publication of images in which they appear.
7. Duration
The licenses and permissions in these Terms apply indefinitely, unless ended by written agreement. Withdrawing consent does not require us to remove images already printed or distributed in physical materials before the request.
8. Governing law
These Terms are governed by the laws of Thailand and form part of the Photography Services Agreement.
